1. Agreement to Terms

By accessing or using oktomise.com (“Site”) or engaging Oktomise(“we”, “us”, “our”) for any services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our Site or services.

2. Services

Oktomise provides digital agency services including, but not limited to:

• Web and app development
• AI integration and business automation
• Digital marketing (PPC, social media, email)
• Search engine optimisation (SEO)
• Consulting and strategy

The specific scope, deliverables, timelines, and pricing for each engagement are defined in a separate Statement of Work or project agreement signed by both parties.

3. Use of the Website

You agree to use this Site only for lawful purposes and in a way that does not infringe the rights of others. You must not:

• Attempt to gain unauthorised access to any part of the Site or its infrastructure.
• Use the Site to transmit spam, malware, or harmful content.
• Scrape, copy, or reproduce our content without prior written consent.
• Misrepresent your identity or affiliation when contacting us.

4. Intellectual Property

All content on this Site — including text, graphics, logos, code, and design — is the property of Oktomise and is protected by copyright and applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Upon full payment for a project, clients receive ownership of the final deliverables (design files, code, etc.) as agreed in the project contract. We retain the right to display completed work in our portfolio unless a separate non-disclosure agreement is in place.

5. Payments & Refunds

Payment terms are defined in each project agreement. As a general policy:

• A deposit (typically 30–50%) is required before work begins.
• Milestone or final payments are due upon delivery of agreed deliverables.
• Invoices are payable within 14 days of issue unless otherwise agreed.
• Due to the custom nature of our services, deposits are non-refundable once work has commenced. We will work with you in good faith to resolve any disputes.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during a project engagement. This includes business plans, technical specifications, client data, and pricing. Confidentiality obligations survive termination of any agreement.

7. Limitation of Liability

To the fullest extent permitted by law, Oktomise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or services. Our total liability for any claim arising out of a project shall not exceed the total fees paid by you for that specific project.

We do not guarantee specific business outcomes, search engine rankings, or advertising performance results, as these depend on many factors outside our control.

8. Third-Party Links & Services

Our Site may contain links to third-party websites or we may recommend third-party tools as part of our services. We are not responsible for the content, privacy practices, or availability of those external sites. Links do not constitute endorsement.

9. Termination

Either party may terminate a project engagement by providing written notice as specified in the project agreement. Upon termination, the client is responsible for payment of all work completed up to the termination date. We reserve the right to refuse or terminate service at our discretion.

10. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any disputes shall be resolved through good-faith negotiation first; if unresolved, through the competent courts of Serbia. For clients in the EU/EEA, your statutory consumer rights under applicable EU law remain unaffected.

11. Changes to These Terms

We may update these Terms from time to time. The “effective date” at the top of this page reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
